1. SUBJECT

NOTICE OF TERMINATION OF EMPLOYMENT.

2. BACKGROUND

You commenced employment with the Company on [START DATE] in the position of [JOB TITLE] under the Contract of Employment dated [—].

3. REASON FOR TERMINATION

After due process and a disciplinary hearing held on [DATE], the Company has determined that your employment must be terminated with effect from [TERMINATION DATE] for the following reasons: [STATE — misconduct / poor performance / operational requirements / etc.].

4. NOTICE

In accordance with section [—] of the Employment & Labour Relations Act, Cap. 366 and your Contract, you are hereby given [28] days written notice. Your last working day shall be [DATE]. The Company elects to: [require you to work the notice period / pay you in lieu of notice].

5. FINAL PAYMENT

Your final payment will include: (a) salary up to the last working day; (b) accrued but untaken annual leave; (c) [pay in lieu of notice — if applicable]; (d) severance pay where applicable under the Act; (e) any contractual entitlements. Statutory deductions (PAYE, NSSF, NHIF) shall apply.

6. RETURN OF COMPANY PROPERTY

On or before your last working day you shall return all Company property in your possession including: laptop, mobile phone, ID card, keys, vehicle, uniforms, files, and any documents or data containing confidential information.

7. POST-TERMINATION OBLIGATIONS

Your obligations of confidentiality, non-compete (if any), and intellectual property assignment under your Contract continue after termination.

8. CERTIFICATE OF SERVICE

You will be provided with a Certificate of Service stating the dates of employment and the position held, in accordance with the Act.

9. RIGHT OF APPEAL

You may appeal this decision in writing to [APPEAL OFFICER] within seven (7) days of this letter. You may also refer the matter to the Commission for Mediation and Arbitration (CMA).

Tanzania labour law strongly protects employees. Termination without just cause AND fair procedure exposes the employer to reinstatement orders + 12 months compensation at the CMA.

Termination in Tanzania — get the procedure right or pay for it

Tanzania has one of the most employee-protective labour regimes in East Africa. Under ELRA Cap. 366, termination must satisfy a two-pronged test: there must be a just cause and the fair procedure must be followed. Failure on either limb makes the termination unfair, opening the employer to reinstatement plus 12 months of pay.

Valid grounds for termination

  • Misconduct — gross dishonesty, theft, insubordination, abuse, etc.
  • Capacity — inability to perform due to ill health, disability or skills gap.
  • Poor performance — after warnings + opportunity to improve.
  • Operational requirements — redundancy due to genuine business reasons.

Fair procedure — the steps

  1. Investigation — gather evidence before any decision.
  2. Notification — written notice of allegations and intended hearing.
  3. Hearing — employee allowed to attend, be heard, and (in some cases) be represented.
  4. Decision — written, with reasons.
  5. Right of appeal — internal appeal process.
  6. Notice or pay in lieu — typically 28 days.
  7. Final pay — accrued leave, pro-rata salary, severance if applicable.

Severance pay

For terminations on operational requirements (redundancy), severance is at least 7 days basic wage per completed year of service. For misconduct dismissals, no severance is payable but accrued leave and pro-rata pay are due.

Common pitfalls

  • "Constructive dismissal" — reducing salary or relocating to force resignation; CMA treats this as unfair termination.
  • Skipping the hearing — even with a valid reason, no hearing = unfair termination.
  • Late final pay — must be paid by the last working day.
  • Withholding the Certificate of Service — illegal; the Act requires it.
