Power of Attorney in Tanzania — when you need one

A Power of Attorney (POA) lets one person (the Donor) authorise another (the Attorney) to act on their behalf. POAs are commonly used in Tanzania for absent property owners, estate administration, business operations during travel, and complex transactions where the principal cannot attend.

General vs Special POA

  • General POA — broad authority covering most personal/business affairs. Use cautiously; limit duration.
  • Special / limited POA — confined to specific transactions (e.g. "sell vehicle T-123" or "operate account 0150-X"). Safer.
  • Durable POA — survives the Donor's incapacity. Used for ageing parents and serious illness planning.

Execution requirements

  1. Drafted in writing.
  2. Signed by the Donor in the presence of a Commissioner of Oaths or Notary Public.
  3. Stamped (TZS 5,000 fixed for non-ad-valorem instruments).
  4. If concerning land or registrable property — registered at RITA within 30 days.
  5. If used abroad — apostilled at the Ministry of Foreign Affairs.

Practical safeguards

  • Limit the scope — never grant unlimited "all matters" authority unless absolutely necessary.
  • Time-limit the POA — don't grant indefinitely.
  • Specify monetary caps — e.g. "may sign contracts up to TZS 10M without prior consent."
  • Revocation — keep your right to revoke explicit; notify all third parties on revocation.
  • Witness carefully — financial fraud via stale POAs is a real risk.

Does a Power of Attorney need to be registered in Tanzania?
A POA must be signed before a Commissioner for Oaths or Notary Public. Where it deals with land, or is meant to be relied on by banks, the Lands office or other third parties, it should also be stamped and registered with RITA. A simple POA used privately may not need registration, but registration gives third parties confidence it is genuine.
What is the difference between a general and a special power of attorney?
A general POA gives the attorney broad authority over the donor's financial, property and business affairs. A special (or limited) POA authorises one specific act or transaction — for example, selling a particular plot of land — and ends once that act is complete.
How do I cancel or revoke a Power of Attorney?
The donor can revoke a POA at any time (while of sound mind) by a written deed of revocation, notifying the attorney and anyone who has relied on it. If the original POA was registered with RITA, register the revocation there too so third parties are on notice.
Can I use this template if I live outside Tanzania?
Yes. Many donors abroad appoint an attorney in Tanzania to handle property or family matters. Sign before a notary in your country of residence; for use in Tanzania the document may need to be notarised and, depending on the country, apostilled or authenticated at a Tanzanian mission before it is registered with RITA.
