Stamp duty in Tanzania
Stamp duty is a tax on legal instruments — contracts, conveyances, leases, mortgages, powers of attorney. The standard ad valorem rate is 1% on the consideration. A schedule of fixed fees applies to non-monetary instruments.
Instruments and their duty
- Conveyance of land or shares — 1% on the price (or market value if higher).
- Lease — 1% on the average annual rent multiplied by the lease term in years.
- Mortgage / debenture — 1% on the secured amount.
- Contract — 1% on the consideration (services, supply, joint-venture).
- Power of attorney — TZS 5,000 fixed.
- Affidavit — TZS 1,500 fixed.
Deadlines and penalties
Stamp duty must be paid within 30 days of execution. Late payment attracts a 25% penalty per quarter of delay, capped at the value of the duty. An unstamped instrument cannot be admitted as evidence in a Tanzanian court.
